Early Legal Protections

  • The British government enacted the Scheduled Area Act in 1874 to protect tribal areas by separating them legally from other regions, which continues to influence how civil and criminal cases are handled in these areas.

Protection of Agency Areas, Land Transfers Act, 1937

  • Originally established in 1917, this law was designed to protect tribal interests by preventing the alienation of tribal lands to non-tribals and abolishing debts owed to moneylenders.

Telangana Region Tribal Areas Rule, 1949

  • Before the 1940s, there was little legal protection for tribal lands in the Telangana region. The law established in 1949 after significant tribal rebellions provided mechanisms for protecting tribal lands and established tribal panchayats.

Scheduled Areas Land Transfers Act 1959

  • Enacted to consolidate and extend previous protections following the formation of Andhra Pradesh, this law included provisions to prevent the transfer of tribal land without government consent.

1 of 70 Act

  • Introduced as a response to ongoing tribal and peasant struggles, this 1970 amendment to the Land Transfer Act of 1959 made it illegal for non-tribals to acquire tribal lands in any form, ensuring that land transactions favored tribal ownership or reverted to the government if no tribal buyers were available.

Constitutionality and Enforcement

  • In 1988, the Supreme Court of India affirmed the constitutionality of the 1 of 70 Act, recognizing it as a crucial measure to protect tribal lands from exploitation and illegal transactions by non-tribals.
