GIRGLANI COMMISSION – REPORT

Failure in Implementing G.O. 610

  • The state government failed to execute G.O. 610.
  • Thousands of non-locals continued in jobs in Zones V & VI of Telangana.
  • More than one lakh non-locals were reportedly working in these zones.
  • Telangana Non-Gazetted Officers (TNGOs) repeatedly demanded their relocation.
  • CM Chandra Babu Naidu appointed retired IAS officer Girglani to investigate the issue.
  • Girglani assumed charge on 26th June 2001 and submitted his report on 30th September 2004.

Investigation Process

  • The commission prepared a questionnaire with 100 questions to identify non-local employees.
  • Sent the questionnaire to various government departments and public establishments.
  • Examined appointments, promotions, postings, and transfers from 1975 to 2004.
  • Consulted employees’ unions, department heads, and state secretaries.
  • Analyzed collected data and compiled a comprehensive report.

Findings of the Girglani Report

  • Identified 126 violations of Presidential Orders.
  • Classified violations into 18 sections and suggested 35 solutions.
  • Report submitted in three volumes with 750 pages.
  • Detailed employee census, region-wise representation, and key recommendations.

Key Chapters of the Girglani Report

Chapter-I: Non-Execution of Presidential Orders

  • Many departments were negligent in enforcing Presidential Orders.
  • Hyderabad was falsely claimed as a Free Zone or Zone VII.
  • General Administrative Department (GAD) misused the Six-Point Formula.
  • Various departments exempted themselves from Presidential Orders using technical loopholes.
  • Lack of a monitoring agency to safeguard Presidential Orders.

Chapter-II: Expansion of State Departments

  • The number of state-level departments increased from 51 (1975) to over 200 (2004).
  • New departments were exempted from Presidential Orders, allowing non-locals to secure jobs.

Chapter-III: Zonal-Level Violations

  • Local offices were converted into state-level offices.
  • Zonal posts were transferred to other zones, particularly Zones V & VI of Telangana.

Chapter-IV: Urban Development Authority Violations

  • Hyderabad Urban Development Authority (HUDA) and Quli Qutub Shahi Urban Development Authority violated local reservation rules.
  • Non-locals were appointed illegally.

Chapter-V: Manipulation of Recruitment Units

  • District-level posts were converted into zonal and state-level posts.
  • Local reservations were bypassed by manipulating recruitment levels.

Chapter-VI: Transfer Violations

  • Para 5(1) of Presidential Order: Prohibited inter-district and inter-zone transfers.
  • Para 5(2) of Presidential Order: Allowed relaxation in special cases.
  • The relaxation clause was misused to transfer non-locals into Telangana.

Chapter-VII: Heavy Development Projects Exemptions

  • Para 14(E) of Presidential Order: Exempted heavy projects from local reservations.
  • G.O.M.S.No. 455 (1985): Brought these projects under local reservation rules.
  • Between 1975-1985, nearly 40,870 jobs were given to non-locals.

Chapter-VIII: Upgrading of Posts

  • Non-Gazetted posts were upgraded to Gazetted posts, reducing local reservations.
  • Telangana lost 10% reservation due to unauthorized promotions.
  • Affected posts included Social Welfare Officers, Sub-Treasury Officers, and M.P.D.Os.

Chapter-IX: Misuse of Compassionate Appointments

  • Families of Andhra employees who died in Andhra region were given jobs in Telangana.
  • Local reservation rules were ignored in these appointments.

Chapter-X: Hyderabad Declared as Free Zone

  • Presidential Order divided the state into six zones.
  • Hyderabad was wrongly declared as Zone VII to facilitate non-local recruitment.
  • Majority of Hyderabad-based offices violated local reservation rules.

Chapter-XI: Fake Residential Certificates

  • Non-locals obtained bogus residential certificates to register in Employment Exchanges.
  • This led to large-scale illegal recruitment in DSC teacher jobs.

Chapter-XII: Violations in Public Service Commissions

  • APPSC, Police Recruitment Board, Medical Board, DSC, and other agencies violated local reservation policies.

Chapter-XIII: Tribal Development Authority and Healthcare Violations

  • Illegal appointments in Integrated Tribal Development Authority (ITDA).
  • Similar violations in Government hospitals (nurse recruitments) and college service commissions.

Chapter-XIV: Immediate and Long-Term Solutions

Immediate Actions

  1. Rectification of Violations: Halt illegal appointments, postings, promotions, and allotments.
  2. Independent Institution: Establish an autonomous body to implement the Girglani report.
  3. Employee Records: Update service registers with native place details and schooling records.
  4. Non-Local Identification: Categorize employees based on local, local merit, non-local quota, and exempted offices.

Long-Term Actions

  • Appoint a Monitoring Authority for Presidential Order violations.
  • Implement a transparent recruitment process to prevent future violations.
  • Strengthen legal frameworks to safeguard local employment rights.
