Legislative Provisions

  • The Rehabilitation Council of India Act, 1992, established the Rehabilitation Council of India (RCI) in 1986, granting it statutory status.
  • The RCI is tasked with regulating and monitoring services for persons with disabilities, standardizing syllabi, and maintaining a Central Rehabilitation Register of qualified professionals in the field.
  • The National Trust for the Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation, and Multiple Disabilities Act, 1999, aims to facilitate the independent living of persons with disabilities by promoting measures for their protection in case of parental death, establishing procedures for appointing guardians and trustees, and ensuring equal opportunities in society.
  • The Rights of Persons with Disabilities Act, 2016, replaced the Persons with Disabilities (Equal Opportunities, Protection of Rights and Full Participation) Act, 1995, aligning with the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD).
  • The Act increased reservation quotas for persons with disabilities to 4% in government jobs and 5% in higher education institutes, emphasized accessibility in public buildings within a specified timeframe, and introduced various provisions for the benefit of persons with disabilities.
  • The Mental Healthcare Act, 2017, administered by the Ministry of Health and Family Welfare, superseded the Mental Health Act of 1987. It aims to provide mental healthcare and related services for persons with mental illness, while safeguarding their rights and promoting their well-being.
